Terms of Service
1. Operator and scope
PowrFlats is operated by Florian Aerni, Harstrasse 94, 4052 Basel, Switzerland ("we"). By creating an account you accept these terms.
2. Service
PowrFlats is a web app for organising shared flats: a shared calendar, grocery lists, expense splitting, pet and plant care, community features, and the AI assistant Matey.
3. Account
You must be at least 13 years old, provide accurate information, and keep your credentials secret. You are responsible for activity under your account.
4. Plans and prices
The Free plan is free of charge and covers the core features with the limits described on the pricing page. Flat Pro costs CHF 4.90 per month or CHF 49 per year per flat — one payer, the whole flat benefits. Flat Pro is currently switched on manually after you get in touch; online checkout will follow. Price or plan changes are announced with reasonable notice and never apply retroactively to periods already paid.
5. Fair use
Quotas (e.g. push notifications, Matey requests) keep the service stable for everyone. Abuse, automated bulk access, circumventing limits, and unlawful content are prohibited. We may suspend or terminate accounts that violate these terms.
6. Your content
Content you enter remains yours. You grant us the right to store and process it as needed to run the app. Content of a flat is visible to its members.
7. Third-party services
Optional features use third-party services (Google Sign-In, Google Gemini for Matey, Open Food Facts, browser push services). See the privacy policy for details. If you store your own API key (BYOK), the respective provider's terms apply to you.
8. Availability
PowrFlats is provided "as is" with no uptime guarantee. We may evolve, change, or discontinue features; a shutdown of the service will be announced with reasonable notice so you can save your data (export or hand-over on request).
9. Liability
To the extent permitted by law, we are liable only for damage caused intentionally or by gross negligence. Liability for slight negligence, indirect and consequential damage (including data loss) is excluded. For paid plans, total liability is capped at the fees you paid in the preceding 12 months. Mandatory statutory liability remains unaffected.
10. Termination
You may delete your account at any time (request to powrflats@gmail.com). We may terminate without notice for violations of these terms. When Flat Pro expires or is cancelled, the flat reverts to the Free plan; data above Free limits is not deleted, but features may be restricted.
11. Changes to these terms
We may update these terms. Material changes are announced in the app or by email; continued use after they take effect counts as acceptance.
12. Governing law and jurisdiction
Swiss law applies, excluding its conflict-of-law rules. Place of jurisdiction is Basel-Stadt, Switzerland. Mandatory consumer-protection rules of your country of residence remain reserved.
